Family Caregiver Leave is one of several unpaid, job-protected leaves under Ontario’s Employment Standards Act, 2000 (ESA), and it is distinct from family medical leave and compassionate care leave.

What Is Family Caregiver Leave?

Family Caregiver Leave is an unpaid leave of up to 8 weeks per calendar year per eligible family member. It is meant to support employees who need to provide care or support to a family member with a serious medical condition.

You don’t need to wait until a medical emergency arises. This leave is designed for care that may be ongoing or intermittent throughout the year.

Key Eligibility Requirements

To take Family Caregiver Leave, three conditions must be met:

  1. You are covered by the ESA
  2. You are providing care or support to an eligible family member
  3. You have a medical certificate from a qualified health practitioner stating the family member has a serious medical condition

There is no minimum length of employment required; you’re eligible from your first day on the job.

Who Qualifies as a “Family Member”?

The ESA takes a broad view of family. You can take this leave to care for:

  • Your spouse or common-law partner
  • Your child, step-child, or foster child
  • Your parent, step-parent, or foster parent
  • Your sibling
  • Your grandparent or grandchild
  • Your uncle, aunt, niece, or nephew (if they are dependent on you)
  • Any person who considers you to be like a close relative, and you consider them the same

How Long Can You Take?

You can take up to 8 weeks per calendar year per qualifying family member. The leave can be taken:

  • All at once
  • A few days or weeks at a time
  • In part days (with employer agreement)

If multiple employees are supporting the same family member (e.g., siblings caring for a parent), each is entitled to 8 weeks individually.

Job Protection and Benefits

While on Family Caregiver Leave:

  • Your job is protected
  • You must be reinstated to your original or a comparable role upon returning
  • Your benefits must be continued as if you were still actively working

Employers are not allowed to penalize, threaten, or terminate you for taking this leave.

How to Request Leave

You should notify your employer in writing as soon as possible. Include:

  • The reason for the leave
  • The expected start and end date (if known)
  • A copy of the medical certificate (if requested)

Employers are allowed to ask for the certificate, but not full medical records.
